Head of the Attorney General's Legal Information Center, Ketut Sumedana said, the public prosecutor is still considering an appeal against the verdicts of four corruption defendants for misusing Bonded Zone and Import Ease for Export Purposes (KITE) facilities at Tanjung Priok and Tanjung Emas Ports 2015-2021. The four defendants in this case are Imam Prayitno as the Head of the Semarang KPPBC, M Rizal Pahlevi as the Head of the Enforcement and Investigation Section of the Semarang Customs and Excise Service and Supervision Office (KPPBC) as well as the DJBC PPNS Investigator, Handoko as the Head of the Intelligence Section of the Java Customs and Excise Regional Office Tengah, and Leslie Girianza Hermawan as Director of PT Eldin Citra.
"Until now the public prosecutor is still thinking about an appeal," said Ketut, Tuesday (31/1).
Based on a copy of the decision in the possession of the Attorney General's Office, the defendants Imam Prayitno and M Rizal Pahlevi were sentenced to eight years in prison and a fine of Rp. 400 million, a subsidiary of two months in prison.
Meanwhile, Handoko was sentenced to two years in prison and a fine of IDR 200 million, a subsidiary of two months in prison. Handoko was also sentenced to an additional penalty in the form of compensation of Rp. 600 million, a subsidiary of a year's imprisonment.
Still in the same trial, said Ketut, the panel of judges Leslie Girianza Hermawan was sentenced to 13 years in prison and a fine of IDR 500 million, a subsidiary of three months in prison. The panel of judges also imposed an additional penalty in the form of a replacement fee of IDR 56.34 billion, taking into account evidence of economic value, a subsidiary of a three-year prison term.
“In the decision also, it stipulates that the length of detention is deducted in its entirety from the prison sentences imposed. Ordered the accused to remain in custody," said Ketut.
In this case, Leslie Girianza Hermawan as a private party had access to a textile company/factory in China to receive orders for textile raw materials from several domestic buyers. In importing textile raw materials, Leslie Girianza Hermawan uses the bonded zone facility of PT Hyupseung Garmen Indonesia (HGI) through the Director of PT HGI named the initials PS. The aim is to obtain exemption from import duties/PDRI and other taxes on textile imports.
On that basis, Leslie Girianza Hermawan imported 180 containers of textile raw materials from the Ports of Tanjung Emas and Tanjung Priok from China. However, the imported textiles are not produced in bonded zones and are exported.
Furthermore, Leslie Girianza Hermawan assisted by Imam Prayitno and M Rizal Pahlevi Customs officers from the Customs and Excise Supervision and Service Office (KPPBC) and MRP officials at the Regional Offices of the Directorate General of Customs and Excise in Central Java and Yogyakarta sell textile raw materials domestically.
From this collaboration, Imam Prayitno and M Rizal Pahlevi received money from each of these containers. Meanwhile, Handoko received money worth two billion rupiah from Leslie Girianza Hermawan via PS.
