The Confederation of Archipelago Trade Unions (KSPN) stated that its members working in the textile and garment industry who were laid off cannot claim Job Loss Guarantee or JKP due to membership status. KSPN President Ristadi said that not all of its members were registered in all BPJS Employment programs as a condition for receiving the Job Loss Guarantee (JKP). “None of our members can because they have not joined the [JP] pension insurance, and there are even arrears in contributions. So to get JKP, in addition to participating in the full BPJS program, the contributions are also smooth," he explained, Friday (11/4/2022).

Previously, Ristadi reported that there had been layoffs for 8,000 members who were laborers in textile companies in the Central Java region. Even though they have become BPJS Employment participants, they cannot make claims because they have not participated in all social security programs.

Based on Article 15 paragraph (1) of Law (UU) No. 24/2022 concerning the Social Security Administering Body, it is stated that employers must gradually register themselves and their workers as participants with BPJS in accordance with the social security program they are participating in.

The same belief also emphasized that if the employer does not comply, administrative sanctions will be imposed, such as written warnings, fines, and not receiving public services.

According to the BPJS Watch Advocacy Coordinator, Timboel Siregar, this sanction is weak because in fact there are still many employers who do not register their workers to become BPJS Employment participants.

"No company has been prosecuted yet, this is indeed weak, in PP No.37/2021 even though it is a maximum of 6 months, BPJS Kesehatan data synchronization with BPJS Employment must be done, but it has not worked. This also prevents workers from participating," he said, Friday (11/4/2022).

Furthermore, Timboel said that there were still few eligible participants or qualified as JKP beneficiaries. The requirements include being registered as a wage earner, participating in all BPJS Employment programs (JHT, JKK, JKM, and JP), and having a contribution period (number of months of payment) of at least 12 months in the last 24 months and paying contributions for 6 consecutive months. prior to layoffs.

BPJS Employment data as of August 2022 shows the number of workers receiving wages or PU is 23.2 million people. Meanwhile, according to Timboel, from this data, only 11 million workers are eligible as JKP recipients.
